Prop 8 Deemed Unconstitutional by 9th Circuit Court

In a groundbreaking decision in what has been one of California’s most heated and controversial battles, the 9th Circuit Court ruled in a 2-1 vote that Proposition 8, which aimed to amend California’s constitution to ban gay marriage, is unconstitutional.

Proposition 8 serves no purpose, and has no effect, other than to lessen the status and human dignity of gays and lesbians in California, and to officially reclassify their relationships and families as inferior to those of opposite-sex couples,” said Judge Stephen Reinhardt in the majority opinion. According to the New York Times, proponents of Prop 8 can either appeal to a larger panel of 9th Circuit Court judges, or take the case to the US Supreme Court.
